6. Quotes, bookings, and service delivery

Quotes and estimates:

  • Quotes remain valid for the period stated on the quote, otherwise 7 days

  • Quotes may change if the scope changes, site conditions differ from what you described, or parts pricing changes

Bookings:

  • You must provide accurate job and site information, including access requirements and safety rules

  • You must ensure safe access to the site, equipment, and work area at the agreed time

  • You must arrange any permits, inductions, escorts, isolation requirements, and lifting plans that are required at your site unless agreed otherwise in writing

Variations:

  • If we identify extra work required, we will discuss it with you

  • If urgent safety issues exist, we may take reasonable steps to make the site safe and notify you as soon as practical

Delays and rescheduling:

  • If you need to reschedule, contact us as early as possible

  • We may charge call-out fees or wasted time where our technician attends and cannot complete work due to access, safety, or site readiness issues

Training:

  • Training and VOC outcomes depend on attendance, participation, and assessment results

  • You must ensure attendees meet any prerequisites we specify

7. Orders, pricing, and payment

Online store orders:

  • When you place an order, you make an offer to purchase

  • We may accept or decline an order, including where stock is unavailable or pricing errors occur

  • If we cancel after payment, we will refund the amount paid for the cancelled item(s)

Pricing:

  • Prices are shown in Australian dollars unless stated otherwise

  • Shipping costs (if applicable) display at checkout or are confirmed before dispatch

  • Prices may change without notice, but changes do not affect accepted orders

Payment:

  • Payment must clear before dispatch of Goods unless we agree otherwise in writing

  • We do not store full card details on our systems. Payment processing is handled by our payment providers

8. Shipping, delivery, and risk

Delivery timeframes are estimates only.

Risk:

  • Risk in Goods passes to you when the Goods are delivered to the address you nominated or collected by you or your carrier

Title:

  • Title in Goods passes to you when we receive full payment (unless otherwise agreed in writing)

Inspect deliveries:

  • Check deliveries promptly

  • Notify us within a reasonable time if Goods arrive damaged, incorrect, or missing

Carrier liability and delivery issues:

  • If you choose to use your own carrier, you authorise us to release Goods to that carrier and risk passes to you when the carrier collects the Goods.

  • If we arrange delivery, we may use third-party carriers. Delivery timeframes are estimates only.

  • To the extent permitted by law, we are not liable for delays, loss, or damage caused by carriers after dispatch, including missed delivery windows, depot delays, weather events, or incorrect delivery details provided by you.

  • This clause does not limit your rights under the Australian Consumer Law.

9. Returns and refunds

If you believe Goods are faulty or not as described, contact us with:

  • Order number

  • Product details

  • Photos where relevant

  • A short description of the issue

Australian Consumer Law:

  • Goods and Services may come with guarantees that cannot be excluded under the Australian Consumer Law

  • Remedies may include repair, replacement, refund, or re-supply of services depending on the issue and whether it is a major failure

Change-of-mind returns:

  • We may offer change-of-mind returns in limited cases, at our discretion

  • Change-of-mind returns may not apply to special orders, customised items, electrical items once opened, or items not in resale condition

  • Shipping costs may not be refundable unless required by law

10. Intellectual property

All content on this website is owned by or licensed to us, including text, images, logos, design, and documents.

You may view and print pages for your own internal business use.

You must not reproduce, distribute, or commercialise website content without our written permission.

13. SMS terms, consent, and opt-out

If you give us your mobile number and you opt in, you agree that RKA Industrial Solutions may send you text messages (SMS) to that number.

SMS use cases may include:

  • Appointment booking confirmations

  • Technician ETA and job updates

  • Quote follow-ups you requested

  • Inspection reminders and compliance follow-ups

  • Invoice, payment, and account notices

  • Online order updates such as dispatch and delivery status

  • Service reminders for scheduled maintenance

  • Safety-related notices linked to a job or site

  • Marketing messages only where you have opted in to marketing SMS

Consent and opt-in:

  • We only send marketing SMS if you have opted in to receive them

  • We may send service and transactional SMS when you request a service, submit a form, book a job, buy from our store, or otherwise ask us to contact you by SMS

  • If a form includes an SMS consent checkbox, you must tick it to opt in

  • Consent is not a condition of purchase

Message frequency:

  • Message frequency will vary based on your bookings, jobs, and account activity

Costs:

  • Standard message and data rates may apply, based on your mobile plan

Opt-out:

  • You can opt out at any time by replying STOP to any SMS from us

  • After you opt out, we will stop sending SMS to that number, except where a message is required to confirm your opt-out or where permitted by law for essential service notices

Help:

  • Reply HELP to any SMS for basic support details

  • You can also contact us using the details in the Contact section of these Terms

Accuracy of mobile number:

  • You must provide a current mobile number you control

  • If your number changes, you must tell us

No sale of SMS consent:

  • We do not sell or share your SMS opt-in data, consent status, or mobile number for third-party marketing

Service providers:

  • We may use service providers to send SMS on our behalf (for example, communications platforms)

  • They may only use your details to deliver messages for us, and must protect the information

14. Liability and disclaimers

Nothing in these Terms excludes, restricts, or modifies consumer guarantees and other rights that cannot be excluded under the Australian Consumer Law.

To the maximum extent permitted by law:

  • We exclude liability for indirect, consequential, or special loss (including loss of profit, revenue, data, or business interruption)

  • Our total liability for any claim connected with Goods or Services is limited, at our option, to:

    • For Goods: repair, replacement, refund, or the cost of repairing or replacing the Goods

    • For Services: supplying the Services again, or paying the cost of having the Services supplied again

You are responsible for:

  • Confirming Goods suitability for your intended application before purchase

  • Using and maintaining equipment in line with manufacturer instructions and applicable standards

  • Ensuring your site and equipment are safe and compliant for work to proceed

15. Indemnity

You agree to indemnify us against claims, losses, and expenses arising from:

  • Your breach of these Terms

  • Your misuse of the website

  • Incorrect or incomplete information you provide that causes loss or delay

  • Unsafe site conditions or failure to provide safe access where you control the site

This clause applies to the extent permitted by law.

16. Suspension and termination

We may suspend or stop providing website access or refuse service where:

  • You breach these Terms

  • You threaten safety, staff, or contractors

  • You do not pay amounts due

  • We reasonably believe we cannot provide the service safely or lawfully

Accrued rights and payments remain payable.

17. Complaints and disputes

If you have a complaint, contact us first and we will try to resolve it promptly.

If we cannot resolve it, either party may pursue external dispute options available under Australian law.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia.

You submit to the non-exclusive jurisdiction of the courts of New South Wales.
